Copyright & Usage Policy

This Copyright & Usage Policy applies across the entire digital platform of the Kashmir Hamadan Craft Revival Foundation (“KHCRF”), including www.khcrf.org and all pages, research sections, publications, registries, archives, databases, artisan profiles, photographs, videos, audio materials, reports, policy resources, evaluation systems, accreditation materials, legislative resources, and other content made available through the KHCRF website.

This Policy explains what KHCRF owns, what remains the property of artisans, communities, contributors, governments, institutions, and other rights holders, and how material published by KHCRF may be used.

1. KHCRF-Created Content

Unless otherwise identified, original content created by KHCRF is protected by applicable intellectual-property laws.

This may include:

• research reports and policy publications;
• market intelligence and analytical material;
• articles, essays, case studies, and knowledge resources;
• original photographs, graphics, illustrations, diagrams, maps, and visualizations;
• original videos, recordings, interviews, and documentary material;
• databases, compilations, classifications, and structured datasets;
• craft documentation and research frameworks;
• website text and editorial content;
• original assessment methodologies and institutional frameworks;
• software, code, digital interfaces, and platform components where applicable;
• KHCRF-created educational and training resources; and
• other original works commissioned, created, or lawfully acquired by KHCRF.

Except where another license is expressly stated, such material may not be commercially reproduced, republished, distributed, sold, modified, licensed, or represented as another party's work without appropriate permission.

2. Copyright Notice

The standard sitewide copyright notice should be displayed as:

The year must be generated dynamically by the website.

Do not hardcode a specific calendar year.

The copyright notice does not mean that KHCRF claims ownership of every item appearing on the website. Ownership and usage rights depend on the nature and source of each item as described in this Policy.

3. Research, Educational, and Public-Interest Use

KHCRF supports legitimate research, education, scholarship, journalism, cultural documentation, policy analysis, and public-interest discussion.

Users may cite KHCRF materials and make reasonable quotations or references where permitted by applicable law, provided that:

• KHCRF is appropriately identified as the source;
• the original meaning is not materially distorted;
• the material is not presented as originating from another institution or person;
• KHCRF endorsement is not implied;
• copyright, attribution, or source notices are not removed;
• use complies with applicable law.

Citation or reference does not transfer ownership of KHCRF material.

Substantial reproduction, republication of complete publications, commercial redistribution, dataset extraction, or systematic reuse may require prior written permission.

4. Recommended Attribution

Unless a publication specifies another citation format, attribution should reasonably identify:

For research publications, reports, datasets, or other formally published material, users should use the citation information provided with the relevant publication whenever available.

5. Artisan and Creator Rights

KHCRF documents the work, knowledge, histories, techniques, objects, workshops, and cultural contributions of artisans and other creators.

Publication or documentation by KHCRF does not automatically transfer an artisan's or creator's copyright or other intellectual-property rights to KHCRF.

Copyright in photographs, artworks, designs, recordings, written contributions, or other creative works may remain with the artisan, photographer, author, filmmaker, contributor, institution, or other applicable rights holder.

Where a specific rights holder or source is identified, users should respect that attribution and any associated usage conditions.

6. Traditional Knowledge and Cultural Heritage

KHCRF recognizes that Kashmir's craft heritage includes inherited skills, motifs, techniques, designs, oral knowledge, cultural expressions, workshop traditions, geographic identities, collective memory, and other tangible and intangible cultural heritage.

The presence of this material on KHCRF does not mean KHCRF claims private ownership over community heritage, traditional knowledge, or cultural expressions merely because KHCRF has documented, researched, indexed, photographed, described, or archived them.

Likewise, public access to documentation does not automatically authorize another person or organization to commercially appropriate, falsely claim authorship of, misrepresent the origin of, or seek exclusive ownership over traditional community heritage.

KHCRF encourages responsible attribution to relevant artisans, communities, traditions, geographic origins, and documented sources wherever reasonably possible.

7. Geographical Indications and Official Records

KHCRF may reproduce, reference, summarize, organize, or analyze geographical indication records, government records, regulatory material, legal documents, official statistics, institutional records, and other authoritative sources.

KHCRF does not claim copyright ownership merely by referencing or organizing material belonging to another authority.

The legal status and rights associated with an official record remain governed by the applicable law and the rights of the issuing authority.

KHCRF's presentation of an official record should not be treated as a substitute for verification with the original issuing authority where legally authoritative confirmation is required.

8. Third-Party Content

The KHCRF website may contain photographs, quotations, documents, datasets, research findings, references, embedded media, links, or other materials originating from third parties.

Such material remains subject to the rights and terms applicable to the original rights holder.

Its inclusion on KHCRF does not mean KHCRF claims ownership of that material.

Where reasonably possible, KHCRF identifies the source or relevant rights holder.

Users wishing to reproduce third-party material should obtain permission from the applicable rights holder where required.

9. User and Contributor Submissions

Artisans, researchers, institutions, photographers, stakeholders, nominees, contributors, legislative offices, and other participants may submit information or creative material to KHCRF.

Submitting material does not automatically transfer copyright ownership to KHCRF.

Unless otherwise agreed, the contributor retains the rights they lawfully hold while granting KHCRF the permissions reasonably necessary to review, verify, store, archive, reproduce, format, display, publish, communicate, and preserve the submission for the purpose for which it was provided and related KHCRF public-interest activities.

Contributors must not knowingly submit material that they do not have the right to provide.

Additional submission terms may apply to particular programs, competitions, archives, registries, publications, research projects, or agreements.

10. Photographs and Visual Documentation

Photographs and visual materials appearing on KHCRF may be:

• created by KHCRF;
• commissioned by KHCRF;
• licensed to KHCRF;
• supplied by artisans or contributors;
• provided by partner institutions;
• reproduced from authorized archives; or
• used from other lawful sources.

Copyright and permitted use therefore vary by image.

Users must not assume that an image is free for commercial reproduction merely because it is publicly visible on the KHCRF website.

Where an image carries a specific credit, copyright statement, license, or usage restriction, that notice governs its use.

11. Audio, Video, Oral Histories, and Interviews

Documentary films, interviews, oral histories, craft demonstrations, workshop diaries, audio stories, recordings, and similar materials may involve multiple rights and interests.

These can include the rights of interviewees, performers, filmmakers, photographers, producers, contributors, archives, and KHCRF.

Downloading, commercially redistributing, substantially reproducing, re-editing, or presenting these materials as another party's production may require permission.

Reasonable quotation, citation, scholarship, criticism, reporting, or educational reference remains subject to applicable law.

12. KHCRF Publications and Reports

KHCRF publications may be downloaded, cited, and used for legitimate personal, educational, research, policy, institutional, or public-interest purposes subject to any specific terms displayed with the publication.

Unless expressly permitted, users may not:

• sell KHCRF publications as their own products;
• remove authorship or attribution;
• substantially reproduce an entire publication under another name;
• create misleading modified versions represented as official KHCRF publications;
• use KHCRF branding to imply approval of an altered publication; or
• commercially redistribute restricted publications without permission.

Individual publications may carry additional copyright, citation, licensing, or access conditions.

13. Databases, Registries, and Structured Information

KHCRF invests substantial research, verification, editorial, and technical effort in organizing craft information, artisan records, evidence repositories, registries, classifications, research datasets, and other structured resources.

Individual facts may have different legal status from the original selection, organization, presentation, analysis, or compilation created by KHCRF.

Public access to a database or registry does not automatically authorize wholesale copying, duplication, commercial republication, automated harvesting, mirroring, or creation of a competing database using substantially extracted KHCRF content.

Reasonable citation and limited research use remain permitted subject to applicable law and any program-specific conditions.

14. Automated Access, Data Extraction, and AI Systems

KHCRF supports legitimate discoverability by conventional search engines, scholarly research systems, and other services operating in accordance with KHCRF's technical access controls.

Public availability of content, however, does not constitute unrestricted permission for bulk extraction.

Without prior authorization, users must not systematically harvest substantial KHCRF publications, databases, artisan profiles, photographs, proprietary classifications, research datasets, or other protected material for:

• commercial dataset creation;
• database replication;
• resale;
• commercial content aggregation;
• unauthorized model training;
• automated generation of derivative commercial repositories; or
• other systematic exploitation inconsistent with this Policy.

Automated systems must respect applicable access controls, security restrictions, rate limitations, robots directives, and other technical measures implemented by KHCRF.

KHCRF may separately authorize research, preservation, indexing, interoperability, or machine-readable access.

15. KHCRF Name, Logo, Marks, and Accreditation Badges

“KHCRF,” “Kashmir Hamadan Craft Revival Foundation,” associated logos, program identities, accreditation marks, certification marks, verification badges, institutional marks, and other distinctive branding may be protected by trademark, copyright, contractual, certification, or other legal rights.

The right to read, cite, or link to KHCRF content does not grant permission to use KHCRF branding in a manner that suggests sponsorship, accreditation, certification, partnership, endorsement, or institutional affiliation.

Accreditation, verification, certification, or recognition marks may be used only by authorized recipients and only within the scope and validity of the applicable authorization.

16. No False Attribution or Endorsement

KHCRF content must not be used in a manner that falsely suggests that KHCRF:

• endorses a commercial product or service;
• supports a political candidate or party;
• certifies an organization that has not been certified;
• sponsors an unauthorized event or initiative;
• approves a modified research finding;
• guarantees the authenticity of an unrelated product; or
• has entered into a partnership that does not exist.

Permitted quotation or citation must remain clearly distinguishable from KHCRF endorsement.

17. Linking to KHCRF

Normal links to publicly accessible KHCRF pages are generally permitted.

Links must not be presented in a deceptive manner or falsely suggest endorsement, sponsorship, accreditation, or partnership.

Framing, mirroring, reproducing, or embedding substantial KHCRF website content in a manner that obscures its source or creates the appearance that KHCRF content belongs to another platform may require permission.

18. Commercial Use

Commercial exploitation of substantial KHCRF-created material requires prior written authorization unless expressly permitted by a separate license.

Requests may include proposed use of:

• complete publications;
• high-resolution photographs;
• documentary material;
• research datasets;
• structured databases;
• proprietary assessment frameworks;
• graphics or maps;
• educational packages;
• archival collections; or
• KHCRF branding.

Permission for one use does not automatically authorize other uses.

19. Copyright and Attribution Corrections

KHCRF seeks to maintain accurate attribution and responsible documentation.

If you believe material has been incorrectly attributed, insufficiently credited, or associated with the wrong artisan, photographer, author, institution, community, or source, you may request a review.

KHCRF may correct, expand, annotate, or update attribution where credible supporting evidence is provided.

20. Copyright Complaints

If you believe that content available on KHCRF infringes copyright or another intellectual-property right that you hold or are authorized to represent, contact KHCRF and provide sufficient information to identify:

• the protected work;
• the material you believe is infringing;
• where the material appears on KHCRF;
• your relationship to the rights holder;
• your contact information;
• the basis of your request.

KHCRF may request additional evidence before acting on a claim.

Where appropriate, KHCRF may temporarily restrict, annotate, correct, or remove disputed material while a matter is reviewed.

Knowingly false infringement claims may themselves violate applicable law or these Terms.

21. Preservation and Archival Copies

Removal of material from public display does not necessarily require destruction of archival, legal, evidentiary, research, security, or administrative records that KHCRF is lawfully entitled or required to retain.

KHCRF may preserve appropriate internal records for institutional, historical, compliance, provenance, or research-integrity purposes.

• applicable accreditation or certification conditions;
• publication-specific licenses;
• submission agreements;
• program-specific rules where applicable.

Where a specific publication, dataset, program, image, archive, or agreement contains its own usage conditions, those specific conditions apply to that material.

24. Changes to This Policy

KHCRF may revise this Copyright & Usage Policy as its research activities, digital systems, collections, programs, partnerships, technologies, and legal obligations evolve.
